Republicans currently hold narrow majorities in both chambers of Congress, leaving control of the legislative branch at stake as voters decide races nationwide.

The electoral landscape has faced extensive legal and judicial oversight. According to an October 20 review by the Brennan Center for Justice, at least 34 federal district court decisions had temporarily or permanently blocked administration initiatives involving election procedures and demands for voter registration records. The administration maintains that its actions protect electoral integrity.

Legal disputes have extended to state voting procedures ahead of the polling. On October 26, a federal appeals court declined to order California to set aside ballots from approximately 20,000 registered voters whom the Justice Department alleges may be noncitizens.

The midterm elections unfold against the backdrop of political tensions stemming from the 2020 presidential cycle. President Trump’s response to his 2020 defeat involved challenging the result, making unsubstantiated allegations of fraud, and pressuring Georgia officials to find enough votes to reverse his loss. Those disputes preceded the January 6, 2021 attack on the Capitol by a mob as Congress met to certify the presidential election.

With the outcome of the midterm elections dictating the future balance of power in Washington, post-election confrontations and challenges to ballot counting could occur.
