MUMBAI — Actor Imran Khan has moved the Bombay High Court to challenge a Foreigners Regional Registration Office (FRRO) notice that directs him to leave India by October 28.

The legal challenge follows Khan’s detention alongside partner Lekha Washington and cousin Zayn Marie Khan during an October 10 demonstration at Mumbai’s August Kranti Maidan. The protest called for the resignation of Chief Election Commissioner Gyanesh Kumar.

The petition, filed through advocates Zulfiquar Memon, Parvez Memon, and Chirag Naik, seeks an urgent stay, the cancellation of the departure order, and an examination of official records. The matter was scheduled to be mentioned for an urgent hearing on Monday.

According to the FRRO notice, Khan is identified as a US national who allegedly violated provisions of the Immigration and Foreigners Act, 2025. The directive gave him 14 days to exit the country, accompanied by a warning of potential prosecution.

However, Khan’s petition argues that the notice was issued without any prior inquiry, show-cause notice, or opportunity to be heard. The filing states that the order fails to specify any actual immigration violations and ignores his status as an Overseas Citizen of India (OCI) cardholder. Furthermore, the plea contends that the demonstration site was not a restricted area and that OCI cardholders are legally permitted to participate in public protests.

The regulatory action originated after Bharatiya Janata Party leader and former MP Kirit Somaiya lodged a formal complaint alleging that Khan had breached immigration rules by engaging in a political demonstration, subsequently demanding his deportation.

During the October 10 protest, Khan maintained that he was participating strictly as a resident of Mumbai rather than representing any political entity. “Apparently, I am going for a ride,” he remarked at the demonstration, where he also questioned restrictions on movement and alleged broader attempts to silence public dissent.
